DECISION & ORDER ON MOTION

Motion by the appellant for the assignment of counsel to pursue a motion in the Court of Appeals for leave to appeal to the Court of Appeals from a decision and order of this court dated September 11, 2007, which determined an appeal from a judgment of the Supreme Court, Kings County, rendered May 13, 1998.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that pursuant to County Law § 722 the following named attorney is assigned as counsel to pursue the motion in the Court of Appeals for leave to appeal to the Court of Appeals:
