DECISION & ORDER ON MOTION FOR REINSTATEMENT

Motion by the respondent for reinstatement as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in Second Judicial Department on March 25, 1959. By decision and order on application of this court dated July May 1, 1995, the respondent was immediately suspended from the practice of law as a result of his conviction of a serious crime, pending further order of this court, pursuant to Judiciary Law §90(4)(f). By opinion and order of this court dated May 13, 1996, the respondent was suspended for a period of one year based on two charges of professional misconduct emanating from his conviction, after a hearing before a Special Referee. By decision and order on application dated July 8, 1997, the respondent's application for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on the respondent's current fitness to practice as an attorney, but the application was subsequently withdrawn due to health reasons. This is a "renewed" motion for reinstatement.

Upon the papers submitted in support of the motion and the papers submitted in response thereto, it is

ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on the respondent's current fitness to be an attorney, including but not limited to, the status of the respondent's health and the nature of his employment activities since he was suspended.
