Youngman, Esq., sworn to October 11 2007, the notice of motion with proof of service thereof, the affirmation of Nigos Karatas, Esq., dated October 25, 2007, the affirmation of Katherine Gladstone, Esq., dated October 26, 2007, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an order deeming the notice of appeal to be timely served is denied, and
It is further ORDERED that motion is in all other respects dismissed.
