Now, upon reading and filing the affidavit of Allen Grant Boyer sworn to

October 17, 2007, the notice of motion with proof of service thereof, the opposing affidavit of Ruthanne Wannop sworn to November 1, 2007, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be, and the same hereby is, dismissed as untimely with respect to the appeals from the orders entered May 25, 2001 (Docket No.

CA 06-03535) and May 24, 2006 (Docket No. CA 06-03536) and the motion is otherwise denied.
