Plaintiff having moved for an extension of time to perfect the appeal taken from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on July 31, 2006, and defendants having cross-moved for an extension of time to perfect their cross appeal from that order and to consolidate that appeal and cross appeal with their appeals from the order and the judgment of the same court entered February 8, 2007 and October 5, 2007,
Now, upon reading and filing the affirmation of Debra A. Norton dated October 12, 2007, the notice of motion with proof of service thereof, the affidavit of Matthew A. Lenhard sworn to
October 25, 2007, the notice of cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be, and the same hereby is, granted to the extent that the first ordering paragraph of the order of this Court entered August 13, 2007 is hereby amended by deleting the date October 12, 2007 and inserting in its place the date
March 28, 2008, and
It is further ORDERED that the cross motion be, and the same hereby is, granted to the extent that the second ordering paragraph of the order of this Court entered August 13, 2007 is hereby amended by deleting the date October 12, 2007 and inserting in its place the date
February 28, 2008, and the appeals and cross appeal from the orders and the judgment entered July 31, 2006, February 8, 2007 and October 5, 2007 are hereby consolidated for the purposes of perfecting and arguing the appeals and cross appeal.
