Appellant having moved to adjourn the oral argument of the appeal taken from the judgment of Ontario County Court entered in the Office of the Clerk of the County of Ontario on March 14, 2003,

Now, upon reading and filing the affirmation of Melvin Bressler, dated October 6, 2007, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be and the same hereby is granted, and the appeal is removed from the calendar for the term of this Court commencing February 19, 2008, and

It is further ORDERED that the appeal is added to the calendar for the term of this Court commencing March 31, 2008.
