| DECISION & ORDER ON MOTION |
Motion by the petitioner in a proceeding pursuant to CPLR article 78 that was transferred to this court by an order of the Supreme Court, Nassau County, dated December 5, 2006, for leave to reargue that branch of its motion which was to enjoin the respondent from enforcing an order of suspension dated June 7, 2006, pending hearing and determination of the proceeding, which was determined by decision and order on motion dated November 7, 2007.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied (see Alcohol Beverage Control Law § 121).
