| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of an order of the Surrogate's Court, Kings County, dated October 29, 2007, pending hearing and determination of an appeal therefrom.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that enforcement of the order dated October 29, 2007, is stayed pending hearing and determination of the appeal or determination by the Surrogate's Court, Kings County, of the appellant's motion for preliminary letters testamentary to be issued solely to him, whichever occurs first, and the motion is otherwise denied.
