Appeal by Hai Guang Zheng from an order of the Supreme Court, Queens County, dated September 21, 2007, which determined his motion pursuant to CPL 440.10 and CPL 440.30(1-a).
Now, on the court's own motion, it is
ORDERED that the appeal from so much of the order as determined the appellant's motion pursuant to CPL 440.10 is dismissed as that portion of the order is not appealable as of right and leave to appeal has not been granted (see CPL 450.10; 450.15).
