Appellant-respondent having moved for an extension of time to perfect the appeal taken from the judgment of Genesee County Court entered in the Office of the Clerk of the County of Genesee on September 12, 2006, and respondent-appellant having moved for an extension of time to perfect its appeal from said judgment,
Now, upon reading and filing the affirmation of Bridget L. Field, dated November 23, 2007, the affirmation of William G. Zickl, dated November 21, 2007, the notices of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion of appellant-respondent be and the same hereby is granted to the extent that the ordering paragraph of the order of this Court entered September 24, 2007 is hereby amended by striking therefrom the date November 23, 2007 and inserting in place thereof the date December 26, 2007, and
It is further ORDERED that the motion of respondent-appellant be and the same hereby is granted on the condition that respondent-appellant perfect the appeal on or before January 25, 2008, and in the event of failure to so perfect, the appeal is hereby dismissed without further order.
