DECISION & ORDER ON MOTION

Motion by the City of New York for leave to intervene on an appeal from an order of the Supreme Court, Kings County, dated November 7, 2007, or, in the alternative, for leave to file an amicus curiae brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to intervene is denied; and it is further,

ORDERED that the branch of the motion which is for leave to file an amicus curiae brief is denied with leave to renew when the appeal is perfected.
