| DECISION & ORDER ON MOTION |
Motion by the respondent Ronnie C. Sampson to direct the appellants to file a supplemental record on an appeal from a decree of the Surrogate's Court, Nassau County, dated January 3, 2007, and to enlarge the time to serve and file a brief. Application by the respondent New York State Attorney General, as the statutory representative of the ultimate charitable beneficiaries, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the application, it is
ORDERED that the branch of the motion which is to direct the appellants to file a supplemental record is denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief and the application to enlarge the time to serve and file a brief are granted, the time of the respondent Ronnie C. Sampson and the respondent New York State Attorney General to serve and file their respective briefs is enlarged until January 9, 2008, and the briefs of the respondent Ronnie C. Sampson and the respondent New York State Attorney General must be served and filed on or before that date.
