DECISION & ORDER ON MOTION

Appeal by Lourdes A. from an order of the Family Court, Kings County, dated May 14, 2007. By decision and order on certification of this court dated September 6, 2007, the following attorney was assigned as counsel for the appellant on the appeal, and was directed, inter alia, to contact the appellant and determine the appellant's interest in perfecting the appeal: Yasmin Daley-Duncan, Esq., 218 Smith Street, Brooklyn, N.Y. 11201, 718-284-3575. By letter dated October 25, 2007, assigned counsel notified the court that she had been unable to contact the appellant. By order to show cause dated November 2, 2007, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered relieving the assigned counsel for the appellant and dismissing the appeal in the above-entitled proceeding.

Upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the assigned counsel is relieved of the assignment; and it is further,

ORDERED that the appeal is dismissed, without costs or disbursements.
