| DECISION & ORDER ON MOTION |
Appeal by Timothy J. Sosnowski from an order of the Family Court, Nassau County, dated June 1, 2007. By decision and order on certification of this court dated August 9, 2007, the following attorney was assigned as counsel for the appellant on the appeal, and was directed, inter alia, to contact the appellant and determine the appellant's interest in perfecting the appeal: Arza R. Feldman, Esq. 626 EAB Plaza, West Tower - 6th Floor, Uniondale, N.Y. 11556, 516-522-2828 . By letter dated October 18, 2007, assigned counsel notified the court that she had been unable to contact the appellant. By order to show cause dated November 1, 2007, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered relieving the assigned counsel for the appellant and dismissing the appeal in the above-entitled proceeding.
Upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the assigned counsel is relieved of the assignment; and it is further,
ORDERED that the appeal is dismissed, without costs or disbursements.
