Motion by the respondents Luke Lambert and Kelly Lambert to dismiss, as untimely taken, an appeal from a judgment dated August 20, 2007, to the extent that it raises issues concerning an order of the same court dated May 21, 2007. Application by the appellant to adjourn the motion.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, and upon the application, it is
ORDERED that the motion is denied (see Matter of Aho, 39 NY2d 241); and it is further,
