DECISION & ORDER ON MOTION

Appeal by MHC Greenwood Village, NY, LLC, from an order of the Supreme Court, Nassau County, dated May 1, 2007. By decision and order on motion dated May 17, 2007, this court granted leave to appeal from the order dated May 1, 2007, and granted a stay of the effective date of Suffolk County Local Law 1534-2006 pending hearing and determination of the appeal or determination of the order to show cause in the above-entitled action, returnable before the Supreme Court, Nassau County, on May 10, 2007, whichever occurs first.

Now on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, on the ground that it has been rendered academic by a judgment of the Supreme Court, Nassau County, entered December 5, 2007; and it is further,

ORDERED that the stay granted by the decision and order on motion dated May 17, 2007, is vacated forthwith.
