It is Ordered that the motion is granted to the extent of continuing the stay of the re-trial on the condition that the appellant perfects its appeal by the April 2008 term of this court - the filing deadline is February 13, 2008. In all other respects, the motion is denied. In the event of appellant's failure to comply with the foregoing condition, the plaintiff-respondent may move on five days' notice for an order vacating the stay.
