Motion by the respondent-appellant and cross motion by the appellants-respondents for leave to reargue stated portions of an appeal and cross appeal from a judgment of the Supreme Court, Suffolk County, entered March 27, 2006, which were determined by decision and order of this court dated October 2, 2007, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court.
