DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, for leave to reargue an appeal from an order of the Family Court, Nassau County, dated January 16, 2004, which was determined by decision and order of this court dated October 17, 2005, and to waive the motion filing fee.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,

ORDERED that the motion is otherwise denied.
