DECISION & ORDER ON MOTION

Motion by the appellant-respondent on an appeal and cross appeal from a judgment of the Supreme Court, Kings County, dated March 1, 2007, to enlarge the record to include certain trial exhibits and other documents and to enlarge the time to perfect the appeal. Cross motion by the respondent-appellant to enlarge the time to serve and file an answering brief, including the points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]).

Upon the papers filed in support of the motion and the cross appeal, and the papers filed in relation thereto, it is

ORDERED that the motion and cross motion are granted; and it is further,

ORDERED that the appellant-respondent's time to perfect the appeal is enlarged until February 29, 2008, and the joint record or appendix on the appeal and the appellant-respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the respondent-appellant shall serve and file an answering brief, including the points of argument on the cross appeal, in accordance with the rules of the court (see 22 NYCRR 670.8[c][3]).
