DECISION

Motion by the People for leave to reargue the order of this court dated September 11, 2007 is granted and, upon reargument, it is provided that that branch of defendant's prior motion seeking summary reversal is denied, that branch of the motion seeking to hold the appeal in abeyance and to remand the matter for a reconstruction hearing is denied, and that branch of the motion seeking an enlargement of time to file an appellant's brief is granted and said brief shall be served and filed within 90 days of the date of the order hereon.
