Appellant having moved for an extension of time to perfect the appeal taken from the order of Chautauqua County Court entered in the Office of the Clerk of the County of Chautauqua on February 14, 2007, and for other relief,

Now, upon reading and filing the affidavit of George L. Anderson, Jr., sworn to November 26, 2007, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion for an extension of time to perfect is dismissed, and

It is further ORDERED that the motion is otherwise denied.

Memorandum: In the absence of a statute expressly authorizing a criminal appeal, there is no right to appeal (see People v Laing, 79 NY2d 166, 170 [1992]). There is no statutory provision that allows for the relief that defendant is currently seeking.
