N.Y.C.H.A. v Lassiter, Sidat

It is Ordered that the motion is granted to the extent of permitting the appeal to proceed on the original record of the trial court. The execution of the warrant of eviction is stayed through March 31, 2008, as provided by the November 29, 2007 order of the Civil Court. Said order conditioned the stay upon the payment of use and occupancy, which has not been paid. The movant is advised to become current in the payment of use and occupancy in order to prevent his eviction. Once the appeal is perfected and the appellant is current in the payment of use and occupancy, the movant may apply for a continuation of the stay beyond March 31, 2008.
