| DECISION & ORDER ON MOTION |
Motion by the plaintiff for leave to appeal to this court from an order of the Supreme Court, Nassau County, dated January 10, 2008, and, in effect, to continue a temporary restraining order that was granted by an order of the same court dated December 17, 2007.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal to this court is denied; and it is further,
ORDERED that the branch of the motion which is, in effect, to continue a temporary restraining order is denied as academic.
