Motion by the appellant, in effect, to hold in abeyance an appeal from a judgment of the Supreme Court, Richmond County, rendered January 30, 2007, pending determination of her motion pursuant to CPL 440.10(e).
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, the appeal from the judgment rendered January 30, 2007, is held in abeyance pending determination of the appellant's motion pursuant to CPL 440.10(e), and the District Attorney of Richmond County is directed to notify this court when the Supreme Court, Richmond County, determines the appellant's motion.
