| DECISION & ORDER ON MOTION |
Motion by Linda Strumpf on an appeal and cross appeal from an order of the Supreme Court, Nassau County, dated June 19, 2007, and appeals from a judgment and an order of the same court entered July 9, 2007, and July 29, 2007, respectively, to dismiss the appeal from the order dated June 19, 2007, on the ground that the issues raised on the appeal from the judgment are barred by the doctrine of Bray v Cox (38 NY2d 350).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof.
