Schopp, Esq., as counsel to perfect said appeal, and an order of this Court having been entered on September 28, 2007, affirming the judgment of the Supreme Court, Erie County,
Now, upon the Court's own motion,
It is hereby ORDERED that Thomas P. Theophilos, Esq., 1201 Colvin Boulevard, Suite 1, Buffalo, New York 14223, is substituted as counsel to represent appellant for the purpose of filing and serving an application for leave to appeal to the Court of Appeals from the order of this Court entered September 28, 2007.
