DECISION & ORDER ON MOTION

Motion by the nonparty-appellant on appeals from two orders of the Supreme Court, Nassau County, dated April 15, 2004, and June 18, 2004, respectively, to vacate the order dated April 15, 2004.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the court's own motion, the appeals are dismissed, without costs or disbursements, on the ground that they have been rendered academic by the settlement of the underlying action; and it is further,

ORDERED that the motion is denied without prejudice to seeking this relief before the Supreme Court, Nassau County.
