| DECISION & ORDER ON MOTION |
Motion by the Village of Chester, David J. Hagsberg, and Timothy McGuire on an appeal from an order of the Supreme Court, Orange County, dated November 2, 2007, for leave to serve an amended notice of appeal correcting the spelling of the name of David J. Hagsberg and adding Timothy McGuire as an appellant.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to serve an amended notice of appeal correcting the spelling of the name of David J. Hagsberg is granted and the notice of appeal is deemed corrected (see CPLR 2001); and it is further,
ORDERED that the branch of the motion which is for leave to serve an amended notice of appeal adding Timothy McGuire as an appellant is denied.
