| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to reargue appeals from an order of the Supreme Court, Westchester County, dated February 23, 2005, and a judgment of the same court dated May 3, 2005, which were determined by decision and order of this court dated March 20, 2007, or, for leave to appeal to the Court of Appeals from the decision and order of this court, and, inter alia, to stay all pending proceedings between the parties in the Supreme Court, Westchester County.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to reargue or for leave to appeal to the Court of Appeals is denied; and it is further,
ORDERED that the branch of the motion which is, inter alia, to stay all pending proceedings between the parties in the Supreme Court, Westchester County, is denied as academic in light of the decision and order on motion of this court dated February 19, 2008, and entered in Appellate Division Docket No. 2007-07017.
