OTA Hotel Owner, LP, et al. v Ross, Joann
It is Ordered that the application, pursuant to CPLR § 5704(b), is hereby granted. The stay contained in the Civil Court Order to Show Cause, returnable on March 4, 2008, is hereby vacated. The warrant of eviction may be executed forthwith, without the need for service of an additional Marshal's Notice of Eviction and after personal service of a copy of this order on the tenant's attorney and filing proof thereof with the Clerk of the Civil Court.
