It is Ordered that the motion is granted only to the extent of vacating the dismissal of the appeal, provided it is perfected by the May 2008 term - the filing deadline is March 12, 2008. In the event of appellant's failure to comply with the foregoing condition, the petitioner may move on five days' notice for an order dismissing the appeal. The motion insofar as it seeks to re-instate the stay is denied. The appellant has failed to comply with the numerous orders of this court requiring the prompt perfection of the appeal.
