DECISION & ORDER ON MOTION

Motion by the respondent to enlarge the record on an appeal from an order of the County Court, Orange County, dated April 21, 2005, to include the transcript of the proceedings which occurred before the County Court, Orange County, on March 22, 2006, and to dismiss the appeal on the ground that it has been rendered academic.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the appeal is dismissed on the ground that it has been rendered academic by the proceedings that occurred on March 22, 2006.
