| DECISION & ORDER ON MOTION |
Motion by the appellant pro se for leave to file an appendix to his supplemental brief on an appeal from a judgment of the Supreme Court, Richmond County, rendered March 14, 2006, and to enlarge the time to serve and file the supplemental brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is for leave to file an appendix to the supplemental brief is denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file the supplemental brief is denied as academic as the supplemental pro se brief was timely filed on January 31, 2008.
