It is Ordered that the motion is granted to the extent of vacating the prior order of this court that dismissed the appeal and vacated the stay, on default. The restored appeal is to be perfected by the May 2008 term. The January, February and March use and occupancy is to be tendered to the petitioner by March 6, 2008, without prejudice. In the event of appellant's failure to comply with the orders of this court, the petitioner may move on five days' notice for an order vacating the stay and dismissing the appeal.
