It is Ordered that the motion is granted to the extent of enlarging the time to perfect the appeal to the May 2008 term of this court and continuing the conditional stay. The cross-motion to release the funds on deposit with the Civil Court is denied, without prejudice to renew in the event the appeal is not perfected by the May term. The prior order of this court is modified accordingly.
