| DECISION & ORDER ON MOTION |
Motion by the appellant on appeals from two orders of the County Court, Rockland County, dated April 25, 2007, and June 28, 2005, respectively, which determined his motions pursuant to chapter 738 of the Laws of 2004, for the assignment of counsel to prosecute the appeal from the order dated April 25, 2007, to consolidate the appeals, to enlarge the time to serve and file a reply brief on the appeal from the order dated June 28, 2005, and for leave to raise issues regarding the appeal from the order dated April 25, 2007, in that reply brief.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is for the assignment of counsel to prosecute the appeal from the order dated April 25, 2007, is denied as unnecessary as Laura G. Weiss, Esq., was assigned to prosecute that appeal by decision and order on motion of this court dated August 31, 2007, as amended by decision and order on motion of this court dated October 12, 2007; and it is further,
ORDERED that the branch of the motion which is to consolidate the appeals is granted; and it is further,
ORDERED that the branches of the motion which are to enlarge the time to serve and file a reply brief on the appeal from the order dated June 28, 2005, and for leave to raise issues regarding the appeal from the order dated April 25, 2007, in that reply brief are granted to the extent that on or before April 11, 2008, the appellant shall serve and file a supplemental brief raising issues regarding the appeal from the order dated April 25, 2007, on or before May 27, 2008, the respondent shall serve and file a supplemental brief to the appellant's supplemental brief raising issues regarding the appeal from the order dated April 25, 2007, and on or before June 11, 2008, the appellant, if he be so advised, shall serve and file one reply brief on the appeals, and those branches of the motion are otherwise denied.
