DECISION & ORDER ON MOTION

Motion by the plaintiff for leave to appeal to this court from an order of the Appellate Term of the Supreme Court, Second and Eleventh Judicial Districts, dated March 28, 2007, which dismissed an appeal from an order of the Civil Court, City of New York, Kings County, entered May 5, 2005, and for poor person relief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the branch of the motion which is for poor person relief is granted to the extent that the motion filing fee is waived and that branch of the motion is otherwise denied as academic.
