| DECISION & ORDER ON MOTION |
Motion by the appellant, in effect, to recall and vacate a decision and order on motion of this court dated January 17, 2008, which dismissed appeals from two orders of the Supreme Court, Westchester County, entered November 9, 2007, and January 3, 2008, respectively, on the ground that no appeal lies as of right from an order that does not determine a motion made on notice, and to reinstate the appeals, or for leave to appeal to this court from the orders entered November 9, 2007, and January 3, 2008, respectively.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
