DECISION & ORDER ON MOTION

Appeal by Davonn P. from an order of the Family Court, Dutchess County, dated July 9, 2007. By order to show cause dated December 28, 2007, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered relieving the assigned counsel for the appellant and dismissing the appeal in the above-entitled proceeding.

Upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to relieve the assigned counsel for the appellant and dismiss the appeal is denied; and it is further,

ORDERED that the matter is referred to the to the Clerk of this court for the issuance of a scheduling order pursuant to § 670.4(a) of the rules of this court (see 22 NYCRR 670.4[a]).
