| DECISION & ORDER ON MOTION |
Motion by Seth Eisenberger for leave to appeal to this court from an order of the Family Court, Rockland County, dated February 1, 2008 (Appellate Division Docket No. 2008-01324), and to stay all proceedings in the Family Court, Rockland County, in the above-entitled matter under Docket No. F-2416/07, pending hearing and determination of the appeal from the order dated March 1, 2007, and an appeal from an order of the Supreme Court, Rockland County, dated January 22, 2008 (Appellate Division Docket No. 2008-01327).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied (see Family Ct Act § 439[e]); and it is further,
ORDERED that the branch of the motion which is to stay all proceedings in the Family Court, Rockland County, is denied.
