| DECISION & ORDER ON MOTION |
Appeals by Robin D. from two orders of the Family Court, Orange County, dated March 5, 2007 (Appellate Division Docket No. 2007-02972), and October 22, 2007 (Appellate Division Docket No. 2007-10797), respectively. By scheduling order dated December 14, 2007, the following named attorney was assigned to prosecute the appeal from the order dated October 22, 2007: Greg Rinckey, Esq., 3 Wemble Court, Albany, N.Y. 12205. By order to show cause dated February 13, 2008, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered, inter alia, dismissing the appeal from the order dated October 22, 2007, for failure to perfect.
Upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion, inter alia, to dismiss the appeal from the order dated October 22, 2007, is denied; and it is further,
ORDERED that on the court's own motion, the briefs filed with respect to the appeal from the order dated March 5, 2007, are deemed also to be the briefs for the appeal from the order dated October 22, 2007, and the appeals are consolidated; and it is further,
ORDERED that counsel assigned to prosecute the appeal from the order dated October 22, 2007, is relieved of the assignment and is directed to turn over all papers in this proceeding to new counsel herein assigned; and it is further,
ORDERED that pursuant to Family Court Act § 1120, the following named attorney is assigned as counsel to prosecute the appeal from the order dated October 22, 2007:
