DECISION & ORDER ON MOTION

Motion by the petitioners for leave to appeal to this court from an order of the Family Court, Queens County, dated January 25, 2008, to stay enforcement of the order pending hearing and determination of the appeal, and, in effect, for a preference in the calendaring of the appeal.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the branches of the motion which are for leave to appeal to this court and to stay enforcement of the order are granted, and the order dated January 25, 2008, is stayed pending hearing and determination of the appeal; and it is further,

ORDERED that the appellants shall perfect the appeal by causing the original papers constituting the record on the appeal to be filed in the office of the Clerk of this court (see 22 NYCRR 670.9[d][2]) on or before April 3, 2008; and it is further,

ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is denied as unnecessary (see Family Ct Act § 1112).
