Appellant having moved to vacate the dismissal of the appeal taken from a judgment of the Ontario County Court entered in the Office of the Clerk of the County of Ontario on February 10, 2005,

Now, upon reading and filing the affirmation of James S. Hinman, Esq., dated December 31, 2007, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be and the same hereby is granted, on the condition that the appeal is perfected on or before June 2, 2008; and

It is further ORDERED that James S. Hinman, Esq. is relieved of his assignment to represent appellant; and
