DECISION & ORDER ON MOTION

Motion by the appellant pro se for leave to reargue his prior motions for leave to prosecute an appeal from a judgment of the Court of Claims dated November 27, 2006, as a poor person and to be furnished with free copies of the transcripts, which were denied by decisions and orders on motion of this court dated April 3, 2007, and July 27, 2007, respectively.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on the court's own motion, the appeal is dismissed, without costs or disbursements, for failure to timely perfect the same in accordance with the rules and prior orders of this court (see 22 NYCRR 670.8[e]).
