DECISION & ORDER ON MOTION

Appeal by Kelly K. from an order of the Family Court, Orange County, dated October 15, 2007. By order to show cause dated February 25, 2008, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding for failure to comply with a scheduling order dated January 17, 2008, issued pursuant to 22 NYCRR 670.4(a)(2). On February 25, 2008, the appellant's assigned counsel in the Family Court filed a certificate of the appellant's continued eligibility for poor person relief, and on February 29, 2008, and attorney was assigned to represent the appellant on the appeal.

Now, on the court's own motion, it is

ORDERED that the motion is denied.
