DECISION & ORDER ON MOTION

Motion by the respondent for an order: (1) granting summary judgment in his favor, (2) staying the disciplinary hearing, and (3) "disqualifying Robert Schneps" from testifying at the disciplinary hearing. By decision and order on motion dated November 7, 2007, the respondent was suspended from the practice of law, pursuant to 22 NYCRR 691.4(l)(1)(ii) and (iii), the Grievance Committee for the Second and Eleventh Judicial Districts was authorized to institute and prosecute a disciplinary proceeding against the respondent, and the Honorable Jerome M. Becker was appointed as Special Referee to hear and report on the issues raised. The respondent's temporary restraining order to stay the disciplinary hearing was stricken from an order to show cause dated January 3, 2008. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on December 11, 2002.

Upon the papers submitted in support of the motion and the papers submitted in opposition thereto, it is

ORDERED that those branches of the motion which are to stay the disciplinary hearing and to disqualify Robert Schneps from testifying are denied as academic because the hearing was conducted on January 9, 2008; and it is further

ORDERED that the branch of the motion which is for summary judgment is denied.
