| DECISION & ORDER ON MOTION |
Motion by the appellant pro se pursuant to CPL 460.30 to extend his time to take an appeal from a judgment of the Supreme Court, Kings County, rendered May 10, 2006.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion, the appeal is dismissed on the ground that the appeal is a duplicate of an appeal under Appellate Division Docket No. 2007-10109; and it is further,
ORDERED that the motion is denied on the ground that the defendant's motion for similar relief under Appellate Division Docket No. 2007-10109 was previously denied by decision and order on motion dated December 31, 2007, as amended by decision and order on motion dated March 12, 2008.
