DECISION & ORDER ON MOTION

Motion by the appellant for leave to prosecute an appeal from a judgment of the Supreme Court, Westchester County, rendered May 9, 2007, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the motion is denied, with leave to renew upon proper papers, including the appellant's affidavit setting forth the amount and source of counsel fees paid to retained counsel on an appeal from a judgment of the same court rendered June 19, 2007, pending under Appellate Division Docket No. 2008-01318, and whether the appellant plans to seek leave to prosecute that appeal as a poor person.
