DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, for leave to appeal to the Court of Appeals from an opinion and order of this court dated January 8, 2008, which determined an appeal from an order of the Supreme Court, Kings County, dated February 2, 2006.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal to the Court of Appeals is denied; and it is further,
